The Delhi High Court on Friday questioned Shah Rukh Khan’s red chilli entertainment and the stability of its defamation petition against Netflix, Sameer Vankhede, director of former drug control bureau (NCB), Sameer Wankhede. The officer had approached the court, seeking a permanent and compulsory prohibition, declaration and loss, which he described as “false, malicious and defamation” in Bollywood’s BA *** DS.

Justice Purushadra Kumar Kaurava asked Wankhedi to establish how his petition was maintained in Delhi and whether there was any reason for action in the national capital. According to the court’s comments, the jurisdiction was an important issue in deciding the acceptance of the petition.
In response, Wankhede’s lawyer, senior advocate Sandeep Sethi argued that the series was available for streaming in Delhi and was seen by the audience in the city, affecting his customer’s reputation locally. The court, however, directed Vankhed to amend their petition to showcase how the reason for action was arisen in Delhi.
Aryan Khan has demanded Rs. 2 crores in loss. Interestingly, he has requested that if the amount is given, then donated to the Tata Memorial Cancer Hospital for the treatment of cancer patients.
The argument alleged that the controversial series, allegedly built by red chilli entertainment and streaming on Netflix, was deliberately conceptualized and blamed Vankhed’s reputation. It further argued that the time was prejudiced, given that the related proceedings related to Wankhed and Aryan Khan are still pending before the Bombay High Court and NDP Special Court in Mumbai.
According to Wankhedi’s claims, the show includes a pornographic gesture – especially after chanting the slogan of “Satyamev Jayate”, showing the middle finger, which is part of the national symbol of India. The argument described the Act as a “serious violation” of the National Honor Act, 1971 prevention of insults, which could attract punitive results under Indian law.
Additionally, the petition stated that the web chain violated the provisions of the Information Technology Act and the Joint Code of India (BNS), which not only damaged their reputation by promoting aggressive, pornographic materials, but also angered the national spirit.
Along with the High Court, Sameer Wankhede is directed to strengthen the judicial base of his petition, the next hearing is expected to determine whether the defamation case may proceed in Delhi. Till then, the controversy around Bollywood’s Ba *** DS keeps both Netflix and red chilli entertainment in the legal spotlight.
