Madras High Court has passed an interim order to restrain internet service providers and cable television operators from unlawfully broadcasting The Kerala Story 2: Goes BeyondWhich was released in theaters on 28 February.
Madras High Court stays illegal telecast of The Kerala Story 2 till March 23
Justice Senthilkumar Ramamurthy had issued the order on March 3 in response to two applications filed by the film’s producer Sunshine Pictures Ltd. The production house had approached the court fearing possible copyright infringement at the time of the film’s theatrical release.
While considering the petition, the court noted that the producer had submitted a Central Board of Film Certification (CBFC) certificate to establish ownership of the copyright of the film. The certificate describes the applicant as the manufacturer, which the Court accepted as prima facie evidence at this stage.
The judge said that in cases involving alleged illegal broadcasting, immediate intervention is often necessary. “In cases of this nature, it is likely that irreparable harm will be caused unless the unlawful transmission is stopped at the border. Also, it is possible that, given the wide-ranging nature of the relief claimed, the legitimate business interests of one or more of the respondents may be affected. Therefore, it is essential that the plaintiff make indemnity in respect thereof,” the Court said.
Accordingly, the High Court granted an ad interim injunction prohibiting unauthorized telecast of the film till March 23, 2026. The order said: “Subject to this condition, orders of ad interim injunction are granted as prayed in these two applications till 23.03.2026. Issue notice to the respondents returnable by 23.03.2026. Private notice is also permitted. The applicant shall comply with Order XXXIX Rule 3 of the CPC.”
The next hearing of the case is to be held on March 23.
