The fight over late industrialist Sanjay Kapoor’s will has already become one of the most-watched legal disputes given the connection of Sanjay’s children with actresses Karisma Kapoor, Adaira and Kiyan. This has intensified in the Delhi High Court as new arguments have cast doubt on the credibility of Priya Kapoor’s defence.

Senior lawyer Mahesh Jethmalani, representing Samaira and Kiaan, rejected Priya Kapoor’s long-standing claim that her exit from Automotive India Pvt Ltd (AIPL) in 2023 was an agreed “swap of position” with Sanjay. Instead, they termed her removal on May 31, 2023 as a direct result of marital discord – arguing that corporate filings show that she neither became the managing director of Raghuvanshi Investments Pvt Ltd (RIPL) nor played any role in the company.
According to Jethmalani, “Priya was never made MD of RIPL…she was removed from AIPL,” contradicting her claims of smooth corporate restructuring. The absence of any parallel placement, he said, undermines his story of a stable blended family and seamless transition – a particularly relevant issue given his repeated references to Karisma Kapoor’s cordial relationship with her children.
What happened after Sanjay’s death in June 2023 is now under even more intense scrutiny. Records presented in the court show that Priya was appointed as director of AIPL a day after his demise, and reinstated herself as managing director within a week. Jethmalani argued that this reflected opportunism, not continuity: “She was not in control when Sanjay was alive. She sought control only after his demise.”
The plaintiffs argue that the corporate timeline too easily aligns with the sudden appearance of the disputed will – a document purporting to determine the legal rights of Sanjay’s heirs, including Karishma’s children.
Further complicating the matter is the conduct of named executor Shraddha Suri Marwah, who, according to the submissions, neither performed probate nor took charge of Sanjay’s estate as required. Jethmalani argued that an executor cannot selectively enforce certain parts of the will. The court was also told that Shraddha claimed to have “deleted” an important email attachment containing the alleged will – despite the email being produced in court.
“You can’t delete attachments without deleting the email,” argued Jethmalani.
With the case re-listed for December 22, the court will continue to investigate the discrepancies around Priya’s corporate role, actions after her death and the missing annexure – these issues are now at the center of the dispute and are having a significant impact on Sanjay Kapoor’s children, his legacy and the businesses he runs.
