The legal battle over industrialist Sanjay Kapoor’s estate deepened on Thursday, as fresh questions were raised over the authenticity of the will submitted by his third wife Priya Sachdev Kapoor following new testimony before the Delhi High Court. Statements made by Shraddha Suri Marwah, named as the executor in the disputed document, along with Kapoor’s children, Samaira and Kiyan, along with actress Karisma Kapoor, have added further uncertainty to the already contentious dispute.

Appearing before the court through her lawyer Anuradha Dutt, Suri admitted that her previous account of how she got the will in the first place was wrong. She now claims that the document was not shared by Priya Kapoor, but by a man named Dinesh Aggarwal, who emailed her on June 14, containing what he said was Kapoor’s will and instructing her to act as executor. According to Suri, Aggarwal later said that he had sent Kapoor’s trust deed by mistake and sent the alleged will again the same day.
The sequence has drawn legal scrutiny, with experts noting that Aggarwal had no authority to appoint an executor or correspond with him, raising questions over the procedural validity of the will. The court also took note of Suri’s admission that he had no prior knowledge of his being appointed executor and that Kapoor himself had not informed him about the role.
Suri further stated that she lacked legal assistance at the time and was “trying to figure out what was going on”, suggesting that her role came to light only after Kapoor’s death, and not through his direct instruction. His request for compensation from Priya Kapoor – unusual for an executor defending a valid will – has added another layer of concern.
The discrepancies continued as Suri recounted a meeting on June 24, during which Priya reportedly assured her that the document was Sanjay’s “last and only will”. However, this claim appears to contradict Priya’s subsequent confession, recorded on August 11, that she was only the nominee for Kapoor’s estate and not the beneficiary. Under Indian succession law, nominees are custodians of property, not heirs – a distinction that can have a significant impact on the outcome of the case.
If the will is ultimately invalidated, Sanjay Kapoor’s estate will be distributed equally among all Class I heirs, including his children Samaira and Kiaan – this is what Suri’s lawyer admitted in court.
The latest developments come against the backdrop of widespread concerns raised by the children’s lawyer, Mahesh Jethmalani, who had earlier pointed to several red flags in the document, including factual inaccuracies, pronoun errors and inconsistent metadata that suggested the will may not have originated from Kapoor’s devices. While Thursday’s testimony heightened doubts rather than resolved them, it appears the case is ripe for a more thorough forensic and procedural review as the court continues its hearings.
This high-profile case has attracted considerable attention from the Indian media, as it involves Sanjay Kapoor’s children Samaira and Kiaan, who are also the children of popular star Karisma Kapoor. While the children are at the forefront of this matter, Karisma has decided to maintain a respectful silence on the matter, showing her respect and support towards the Indian judicial system.
