Bar & Bench reports, “Bollywood actor Suniel Shetty has moved the Bombay High Court to protect his personality rights. The actor has said that several social media pages and websites use his image to promote their businesses. The actor also cited the example of a deeply faked photo with his grandson.”

The move comes amid a growing trend of celebrities taking legal action to protect their personal and professional identities. In recent times, stars like Aishwarya Rai, Abhishek Bachchan, Amitabh Bachchan, Karan Johar and Akkineni Nagarjuna have also approached the courts to protect their personality rights from online abuse.

Earlier this month, the Bombay High Court had issued an order protecting veteran playback singer Asha Bhosle from unauthorized use of her identity. The court barred several entities from exploiting her name, image or voice – which apparently also includes manipulation using Artificial Intelligence (AI). The judgment emphasized that enabling an AI tool to replicate a celebrity’s voice without consent is a violation of identity rights.

The Delhi High Court, while upholding the Aishwarya Rai verdict, had said, “Personality rights of individuals, simply put, include the right to control and protect the exploitation of one’s image, name, likeness or other characteristics of the person’s personality as well as the commercial benefits derived therefrom. Personality rights can be rooted in the autonomy of individuals to allow the exploitation of likenesses or other characteristics of their personality.” Can or can refuse.” rights.

Personality rights give individuals legal rights over the public and commercial use of their identity. These rights protect unique characteristics such as someone’s image, voice, signature, or catchphrase. They are broadly divided into the right of publicity, protection against unauthorized commercial use and the right to privacy, which protects individuals from abuse through deepfakes, manipulated images, fabricated endorsements or intimate material.
