The ongoing legal dispute between producer Vashu Bhagnani’s Pooja Entertainment and Tips Music has reignited the long-standing debate over ownership of film music rights in the Indian film industry. The controversy began when Pooja Entertainment approached the court alleging that Tips had recreated the iconic track ‘Chunari Chunari’ for the upcoming movie If you are young then you have to fall in love Without obtaining permission. Responding to the matter on social media, Tips Music insisted that they remain the “legitimate owners” of the music rights and described the allegations made by Pooja Entertainment as “malicious”. Responding to TIPS’ statement, a legal spokesperson representing Vashu Bhagnani said that all the music rights, songs and films referenced in the suit are currently covered under the court’s “status quo” order. The spokesperson further said that, at this stage, the issue of legal ownership or the validity of the agreements cannot be determined as the matter is now under the jurisdiction of the court.
The spokesperson also said that the actors, filmmaker David Dhawan, producers, technicians and everyone associated with the case may be required to appear before the court and give their response, otherwise they may face contempt proceedings.
The spokesperson termed the interim relief as an important development and called it a victory for filmmakers and said producers across the industry should come together to protect their rights. According to the statement, music companies have over the years generated massive revenues from rights and investments that originally belonged to producers, making it important for producers to collectively assert their claims. The spokesperson said this interim order is only a beginning and expressed hope that complete justice would eventually be served.
