The petition was filed on February 5, 2026, by Mahendra Chaturvedi, who describes himself as an Acharya dedicated to the study and teaching of Indian scriptures, philosophy and spiritual traditions. The petition, submitted through advocate Vineet Jindal, seeks a mandamus directing the concerned authorities, including the Union of India and Netflix India, to stay the release and streaming of the film until the legal challenge is resolved.

The core of the petition is the objection to the title of the film, Infiltrator PanditThe petitioner states that the term conflates the term “Pandat” (a type of Pandit, traditionally associated with scholarship, ethical conduct and spiritual guidance) with Ghuskhor (a term denoting bribery and corruption). The petition argues that this association harms the dignity, reputation and cultural identity of the Brahmin community and also affects the personal business of the petitioner.

According to the petition, the headline and promotional material are stereotypical and defaming an entire religious and social group. It claims that such portrayal amounts to mass defamation and is thus communally offensive which may disrupt public order and social harmony.

The petition argues that the content in question violates fundamental rights protected under Articles 14 (equality before law), 21 (protection of life and personal liberty) and 25 (freedom of conscience and religion) of the Constitution of India. Recognizing the right to freedom of speech and expression under Article 19(1)(a), the petition said this right is subject to reasonable restrictions under Article 19(2) in cases of hate speech, defamation or material disturbing communal harmony.The petitioner also criticized the absence of an effective regulatory framework for OTT platforms, arguing that gaps in existing oversight enable the promotion of content that could incite communal tension or harm social unity. He has sought interim relief in the form of a stay on the release of the film till the full hearing of the case.

Netflix India and its creators Infiltrator Pandit has not yet responded publicly to the petition or response. The film stars Manoj Bajpayee in the lead role as a police officer nicknamed “Pandat” and was recently unveiled by Netflix at an industry event as part of its 2026 content slate.
